2. The petitioner apprehends his arrest in connection with Sheikhpura P.S. Case No.196 of 2023, registered for the offence punishable under Sections 4, 3, 5, 6 of the Immoral Traffic (Prevention) Act.

3. Allegedly, police conducted a raid in the hotel of the petitioner located at bypass road. During the search, the petitioner and the manager fled away but a woman was found who disclosed her name as Soni Devi and she disclosed that she does flesh trade for her livelihood. She also disclosed that the petitioner and the manager of the hotel gave her Rs.800/- per man for flesh trade.

4. It is submitted by learned counsel for the petitioner that petitioner is quite innocent and have committed no offence. He

Patna High Court CR. MISC. No.2514 of 2024(2) dt.08-02-2024 2/2 has been falsely implicated in this case. No such occurrence, in the manner as alleged, has ever taken place. The allegation levelled against the petitioner is not specific rather general and omnibus in nature. She submits that no material has been found against the petitioner to support the prosecution case. Petitioner is the owner of the said hotel but he has given the same on lease to one Sanjay Kumar. He has been made accused on the basis of statement of apprehended woman. Petitioner has no criminal antecedent.

5. Learned APP for the State opposed the prayer for anticipatory bail by submitting that the petitioner is also involved in the present case.

6. Having regard to the facts and circumstances of the case as well as considering the nature of offence, I am not inclined to enlarge the petitioner on bail. The prayer for grant of anticipatory bail on his behalf is hereby rejected.
