2. The petitioners are in custody in connection with Gehlaur P.S. Case No. 34 of 2025 for the offence punishable under sections 80, 238 and 3(5) of the Bharatiya Nyaya Sanhita, lodged on 21.04.2025 by the informant, Vinod Singh.
3. As per the prosecution story, the informant alleged that on phone call that the girl has been murdered, they rushed to the place, the deceased was taken to the crematorium, the body was on the pyre, the accused thereafter escaped, leaving the half burned body. This led to the F.I.R.

Learned counsel for the petitioners submit that they are sister-in-law (gotni) and brother-in-law (Bhaisur), staying in the Gaya Ji township for better education of the child, were not at the place of occurrence which is forty kilometers away, they have no criminal antecedent and have remained in custody since 30.07.2025.
5. Learned APP opposes the prayer for bail submitting that allegation has come against all the family members.

Considering the submissions of the parties as also the fact that they are sister-in-law (gotni) and brother-in-law (Bhaisur) as would manifest from the petition itself, residing in Gaya Ji township, F.I.R. is there, shall be facing the music, in that background, this Court is inclined to extend them the privilege of bail with conditions.
7. Let the petitioners be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of like amount each to the satisfaction of learned Judicial Magistrate, First Class, Gaya Ji, in connection with Gehlaur P.S. Case No. 34 of 2025 subject to the following conditions:
(i) one of the bailor should be the family member/relative of the petitioners who shall provide official

(ii) the petitioners shall appear on each and every date before the Trial Court and failure to do so for two consecutive dates without plausible reason will entail cancellation of their bail bond by the Trial Court itself;
(iii) the petitioners shall in no way try to induce or promise or threat the witnesses or tamper with the evidences, failing which the State shall be at liberty to take steps for cancellation of the bail bonds;
(iv) the petitioners shall desist from committing any criminal offence again, failing which the State shall be at liberty to take steps for cancellation of their bail bonds. (Rajiv Roy, J) vinayak/- U T
