JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-12-2019 Petitioner seeks bail in anticipation of his arrest in connection with Dumariyaghat P.S. Case No. 117 of 2019 registered for the offences punishable under Sections 341, 323, 324, 307, 379, 504 and 506/34 of the Indian Penal Code. As per FIR petitioner is said to have assaulted by means of sword on the head of the informant.

Submission of learned counsel for the petitioner is that there is dispute between the parties with respect to passage and for that scuffle took place between the children of the parties, due to that occurrence took place and there is case and counter case and now the parties have compromised the matter. Heard learned APP also.

In view of above facts and circumstances, let

Patna High Court CR. MISC. No.83904 of 2019(2) dt.18-12-2019 2/2 petitioner, in the event of arrest or surrender, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-I, East Champaran at Motihari, in connection with Dumariyaghat P.S. Case No. 117 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
