The petitioner has filed the instant application for grant of bail in a case registered for the offence under section 30 (a) of the Bihar Prohibition and Excise Act, 2016. As per the allegation in the FIR, three accused persons including this petitioner were carrying liquor in plastic bags in their hand. It is further alleged that seeing the police personnel they left the bags and escaped. Thereafter, in presence of two witnesses, 23.52 litres of IMFL is said to have been recovered. It is submitted by learned counsel for the petitioner that the allegation of recovery of liquor is false and concocted, the recovery is said to have taken place from the road side, he has no criminal antecedent and is in custody since 30.09.2019.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, the Court is inclined to enlarge the petitioner on bail. Let the petitioner, above named, be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District Judge 2nd -cum-Special Judge, Excise Act, Samastipur in connection with Tajpur P.S. Case No. 347 of 2019.
