1. Heard learned counsel for the parties.

2. The petitioner in this application prays for bail apprehending his arrest in connection with Minapur P.S. Case no.310 of 2024 registered for the offence punishable under sections 318(4), 303(2), 338, 336(3) and 339 of the Bharatiya Nyaya Sanhita.

3. As per the prosecution case, the allegation against the petitioner is that after having forged the signature of Mukhiya, the petitioner made an incorrect marriage certificate and obtained a grant of Rs.50,000/ from the Government. The FIR further states that subsequently on the matter being discovered, he deposited the said amount.

Patna High Court CR. MISC. No.86009 of 2024(2) dt.20-12-2024 2/2 implicated in the case for oblique reasons by his enemies in the village. The allegations are false, malicious and concocted. The petitioner has no criminal antecedent and undertakes to cooperate in the case.

5. The application for bail is opposed by learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the nature of allegation against the petitioner in the FIR, the FIR itself reflecting that the petitioner deposited back the amount of Rs.50,000/ which he had allegedly taken on the basis of the certificate and the petitioner not having any criminal antecedent, it is directed that the petitioner, above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks, be released on anticipatory bail in connection with Minapur P.S. Case no.310 of 2024 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Muzaffarpur (East), District Muzaffarpur.
