2. The present application has been filed seeking cancellation of the anticipatory bail granted to Opposite Party no. 2 vide order dated 29.03.2022 passed in Cr. Misc. No. 47689/2021 arising out of Jamobazar P.S. Case No. 14 of 2021, registered under Sections 498A/ 34 of the I.P.C. and Sections 3 / 4 of the Dowry Prohibition Act.

3. Learned counsel for the petitioner submits that O.P. No. 2 has failed to comply with the order of this Court and has not paid maintenance to the petitioner.

4. In view of the aforesaid submission, learned

Patna High Court CR. MISC. No.86702 of 2024(3) dt.16-07-2026 2/2 counsel for the petitioner seeks permission to withdraw the present application with liberty to approach the court below, by filing an appropriate application on the aforesaid ground.

5. Accordingly, the present application is dismissed as withdrawn with the aforesaid liberty.

6. If such an application is filed, the same shall be considered and decided by the Magistrate concerned, in accordance with law, within a period of two weeks from the date of its filing.

7. If the Magistrate concerned, finds the allegations of the petitioner to be true, then bail bond of O.P. No. 2 shall be cancelled forthwith.
