The petitioner, in the present case, is seeking regular bail in connection with Chautham P.S. Case No. 122 of 2017, registered for offences alleged under Sections 302, 120 (B)/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that as per the First Information Report, one Sanuj Muni had given a telephonic call and had talked with the husband of the informant. As per allegations, while leaving the house he told the informant that Sanoj Muni, Laddu Muni and Kare Singh were calling him to the other side of the river where arrangements were made for dinner. Learned counsel submits that so far as this petitioner is concerned he has been made accused in the later part of the First

Patna High Court Cr.Misc. No.51826 of 2018 (3) dt.20-09-2018 2/2 Information Report wherein the informant has claimed that she had a belief that all those persons named therein had shot dead her husband due to old enmity. It is stated that similarly situated coaccused have been granted regular bail by this Court in Cr. Misc. No. 37187 of 2018, Cr. Misc. No.57604 of 2017 and Cr. Misc. No. 20097 of 2018.

Learned APP for the State is present and has opposed the prayer for bail.

Considering the facts and circumstances of the case, where this petitioner has been named among other co-accused and the similarly situated co-accused have been granted the privilege of regular bail by this Court, let the petitioner, above named, be enlarged on bail on his furnishing bail bond of Rs.15,000/- (Fifteen thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Khagaria in connection with Chauthan P.S. Case No. 122 of 2017, subject to the conditions U/S 437(3) Cr.P.C.
