1. Heard the parties.

2. The petitioner apprehends his arrest in connection with Imadpur P.S. Case No. 120 of 2025 dated 29.09.2025 registered under Sections 30(a) of the Bihar Prohibition and Excise Amendment Act, 2022.

3. As per the first information report a total quantity of 49 liters of country made liquor has been recovered from a TVS motorcycle bearing registration no. BR03AM6642.

4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case only because he happens to be the registered owner of the seized motorcycle in question. The villager of the petitioner namely Ashok Kumar had borrowed his motorcycle for the purpose of purchasing some medicines for his ailing mother and the petitioner has no knowledge that his motorcycle was being used

Patna High Court CR. MISC. No.82152 of 2025(2) dt.10-12-2025 2/2 for transpiration of illicit liquor. The petitioner has no criminal antecedent.

Regard being had to the submission made by the parties, taking into consideration the fact that illicit country made liquor has not been recovered from the conscious possession of the petitioner, justification given regarding recovery of liquor from the motorcycle in question and the petitioner has no criminal antecedent, accordingly , I am inclined to grant anticipatory bail to the petitioner.

Let the petitioner, above named, be released on anticipatory bail in the event of arrest or surrender before the court below within a period of four weeks from today on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of Mr. Sandeep Kumar Mishra, learned Exclusive Special Judge Excise Court No.-I, Bhojpur at Ara in connection with Imadpur P.S. Case No. 120 of 2025 subject to the condition as laid down under Section 482 (2) of the B.N.S.S. 2023.
