This is the second attempt on behalf of the petitioner for grant of regular bail in connection with Ara Nagar P.S. Case No.62 of 2023 registered for the offence under sections 20 & 21(c) of the N.D.P.S. Act. Earlier, the prayer of the petitioner for grant of bail has been rejected by this Court vide order dated 09.04.2024 passed in Criminal Miscellaneous No.3485 of 2024.

The recovery is of 293 grams of heroin. The petitioner is in custody since 03.09.2023.

It has been submitted that in the trial out of five witnesses, two witness have been examined. 5.
Considering the fact that the recovery of heroin is of commercial quantity and the trial is going on, I am

The Superintendent of Police, Bhojpur is directed to ensure the attendance of witnesses in the trial. If the witnesses do not appear in the trial regularly then appropriate order shall be passed against the concerned police official(s). 7.
Let a copy of this order be communicated to the Superintendent of Police, Bhojpur forthwith through FAX for its compliance.
