JUSTICE VINOD KUMAR SINHA ORAL ORDER 03-02-2020 The petitioner seeks regular bail in connection with Special Case No. 7846 of 2019 arising out of Sultanganj P.S. Case No. 247 of 2019, registered for offences punishable under Sections 30(a) of the Bihar Prohibition and Excise Act, 2016. Allegation is of recovery of 4 litres of liquor from the petitioner and apart from that he is accused in three more cases of similar nature.

It has been submitted on behalf of the petitioner that he has falsely been implicated in this case and in fact nothing has been recovered from the petitioner. Further he has no criminal antecedent and has been in judicial custody since 01.09.2019.

Heard learned A.P.P. also.

No.82130 of 2019(4) dt.03-02-2020 2/2 Having heard both sides, considering the facts and circumstances of the case, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Act, Patna in connection with Special Case No. 7846 of 2019 arising out of Sultanganj P.S. Case No. 247 of 2019 subject to the condition that petitioner has to appear before the Officer-in-Charge of the police station of his area in the first week of each month for a period of six months so that the police may watch his activities during that period.

Let a copy of this order be communicated to the Senior Superintendent of Police, Patna as well as the Superintendent of Excise, Patna for needful.
