This application for regular bail arises out of Bettiah Town P.S. Case No. 660 of 2019, disclosing the offence under Sections 3, 4, 5, 6, 7 and 8 of the Immoral Traffic (Prevention) Act.
The petitioner is in custody since 07.09.2019. Allegedly, from a hotel the police, in a surprise check, found couples in different rooms of the hotel in suspicious circumstances. The police are said to have recovered some amount of foreign liquor also from the said hotel. Learned counsel appearing on behalf of the petitioner has submitted that though the petitioner has been described to be the Manager of the hotel, he was, in fact, working as one of the
Patna High Court CR. MISC. No.77403 of 2019(2) dt.17-12-2019 2/2 staffs there. He further contends that other persons, who were apprehended by the police, have been allowed regular bail by this Court.
Considering the facts and circumstances of the case and the nature of allegation, this application is allowed. Let the petitioner, above-named, be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand), with two sureties of the like amount, each to the satisfaction of learned C.J.M., West Champaran at Bettiah in Bettiah Town P.S. Case No. 660 of 2019.
This is subject to the condition that the petitioner shall present himself before the Police/ Court, as the case may be, as and when required and in the event of failure on his part to appear before the court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
