On account of disappearance of the victim, informant, her father instituted this case which has been registered against unknown. From para-25 of the case diary, it is apparent that police officials after receiving information regarding arrival of the victim at Bagaha Station, rushed to the station and found the victim alone. She was taken and then handed over to her parents and subsequently, medically examined, statement under Section 164 CrPC was recorded (Para-64) whereunder she had put an allegation against the petitioner to have enticed her away and during course of stay with Deepak at Bettiah, he (Depak) committed rape.

Patna High Court CR. MISC. No.75718 of 2019(3) dt.27-05-2020 2/2 Petitioner happens to be under custody since 13.06.2019 having a fair antecedent as per para-3 of the instant petition. Consequent thereupon, petitioner, Chandrashekhar Thakur @ Krishna Thakur is directed to be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Additional District Judge-1stcum-Special Judge, (SC/ST/POCSO) Bettiah, West Champaran in Laukariya PS Case No. 23/2019.
