1. Heard learned counsel for the petitioner and learned APP for the State.
2. The petitioner seeks bail in a case registered for the offence punishable under Sections 147, 148, 149, 341, 342, 302, 504, 506 of the Indian Penal Code & Section 27 of the Arms Act.
3. Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and is in custody since 13.08.2024 and charge sheet has been submitted. It is further submitted that from perusal of the allegation as alleged in the F.I.R., it would manifest that specific allegation of firing is against Gonga Paswan and the allegation against the petitioner is general and omnibus in nature. It is further submitted that similarly situated co-accused Indal Paswan and
Patna High Court CR. MISC. No.85808 of 2024(2) dt.10-01-2025 2/2 Pintu Paswan had approached this Court seeking regular bail by filing Criminal Miscellaneous No. 68756 of 2024 and the same was allowed by an order dated 09.12.2024, as such, the petitioner, based on parity, seeks bail.
4. Learned A.P.P. for the State opposes the prayer for bail of the petitioner.
5. Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Bind P.S. Case No. 52 of 2024.
