2. The instant application for anticipatory bail have been filed by the petitioners apprehending their arrest in connection with Koransarai P.S. Case No. 50 of 2024 instituted for the offence under Sections 191(2), 191(3), 190, 329(3), 115(2), 109, 303(2), 351(2) and 351(3) of Bharatiya Nyaya Sanhita.
3. The case of the prosecution is that the petitioners
Patna High Court CR. MISC. No.88316 of 2024(2) dt.10-01-2025 2/3 along with others being armed with weapon arrived and surrounded the informant. Parsuram Singh and Rajrishi Singh were having pistol in their hand and pointed the pistol towards the informant. After that it is alleged that Gaya Singh assaulted with lathi on the head of the informant. Keshodhari Singh and Roushan Singh assaulted with lathi on the hand of the informant. When the cousin brother of the informant namely, Vivek Kumar came to rescue, he was being assaulted by all the accused persons.
4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has falsely been implicated in this case. It is also submitted that there is also a counter version of this case. It is next submitted that the petitioners have also received injury in that case. From perusal of the injury report, it is clear that the injury report of the informant shows that he has received simple injury caused by hard and blunt substance whereas the injuries of one Vivek Kumar is grievous but from perusal of the FIR, it is clear that the nature of allegation against Vivek Kumar is general and omnibus.
5. In contra, learned APP appearing for the State opposes the prayer of bail of the petitioners.

6. Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioners on bail. The petitioners are directed to surrender in the Court below within a period of four weeks from today and in the event of their arrest or surrender in connection with Koransarai P.S. Case No. 50 of 2024, they will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar subject to the conditions as laid down under section 438(2) of the Cr.P.C.
