This application for regular bail arises out of Rajoun P.S. Case No. 354 of 2019, disclosing offence punishable under Sections 147, 148, 149, 353, 323, 332, 386 of the Indian Penal Code.

It is alleged in the FIR that the named accused persons and others were extorting money from the persons moving in vehicles and passing through a road near a middle school. It is alleged that when some of the drivers/ vehicle owners resisted, they obstructed completely, the movement of traffic of the road. When the police intercepted, they are said to have entered into altercation and scuffle with the police party

Patna High Court CR. MISC. No.79785 of 2019(2) dt.10-01-2020 2/2 also. One of them was arrested. The petitioner was implicated on the basis of video footage and from the possession of Kundan Yadav, who was arrested, a sum of Rs. 1700=00 was recovered.

Learned counsel for the petitioner has submitted that said Kundan Yadav has been allowed regular bail by this Court by order dated 21.10.2019, passed in Cr. Misc. No. 68558 of 2019.

Considering the above submission, this application is allowed. Let the petitioners, above-named, be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand), each with two sureties of the like amount, each to the satisfaction of learned Chief Judicial Magistrate, Banka in Rajoun P.S. Case No. 354 of 2019.

This is subject to the condition that the petitioners shall present themselves before the Police/ Court, as the case may be, as and when required and in the event of failure on their part to appear before the court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
