The petitioner has filed the instant application for grant of anticipatory bail apprehending his arrest in a case registered for the offence under section 30 (a) of the Bihar Prohibition and Excise Act, 2016.
As per allegation in the complaint against the petitioner, on raid being conducted a total of 144 litres of Nepali liquor is said to have been recovered from the house of one Suresh Sahni and this petitioner has been made accused stating that he is one of the associates of the said Suresh Sahni.
It is submitted by learned counsel for the petitioner that neither any recovery has taken place from the possession of the
Patna High Court CR. MISC. No.76544 of 2019(2) dt.13-02-2020 2/2 petitioner nor it is so alleged in the complaint. It is further submitted that he has no connection whatsoever with the aforesaid Suresh Sahni. The petitioner has no criminal antecedent.
The application for bail has been opposed by learned APP for the State.
Having heard learned counsel for the parties and taking into consideration the fact that no recovery has taken place from the person of the petitioner who has no criminal antecedent, this Court is inclined to enlarge the petitioner on bail. The petitioner above named, in the event of his arrest or surrender in the Court below within a period of six weeks from today in connection with C2-115 of 2019 is directed to be enlarged on bail on furnishing bail bond of Rs 10,000.- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 1st Additional Sessions Judge-cum-Special Judge, Excise, Sheohar, subject to the conditions as laid down in section 438 (2) of Criminal Procedure Code.
