JUSTICE SANJAY PRIYA ORAL ORDER 27-09-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in connection with Sessions Trial No. 284 of 2016 arising out of Amarpur P.S. Case No. 315 of 2013 instituted for the offence under Sections 366(A)/34 of the Indian Penal Code.

Counsel for the petitioner submits that victim girl has performed marriage with the petitioner and both are living together as husband and wife. They have children from the marriage.

The statement of victim girl recorded under Section 164 Cr. P.C. has been enclosed as Annexure-2 wherein she has stated her age as 21 years. She has stated that petitioner is her husband and she is living with him along with her two children.

Patna High Court Cr.Misc. No.53414 of 2018 (3) dt.27-09-2018 2/2 Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned District & Sessions Judge, Banka, in connection with Sessions Trial No. 284 of 2016 arising out of Amarpur P.S. Case No. 315 of 2013, subject to the condition that both the bailors will be the close relatives of the petitioner.
