1. Heard learned counsel for the petitioner and learned APP for the State

2. The petitioner has preferred this application for grant of regular bail in connection with Islampur P.S. Case no. 155 of 2023 registered under section 392 of the Indian Penal Code to which sections 395 and 412 of the Indian Penal Code were added subsequently.

3. As per the prosecution case, four accused persons on two motorcycles are said to have overtaken the informant and looted him of his motorcycle and mobile phone.

4. Learned counsel for the petitioner submits that the F.I.R was registered against unknown. Referring to the order of the learned trial Court it is submitted that name of the petitioner transpired in course of investigation in the confessional statement of the co-accused Dipak Kumar. The said Dipak Kumar has been enlarged on bail vide order dated 9.11.2023 passed in Cr. Misc. no. 72410 of 2023. No incriminating article

Patna High Court CR. MISC. No.1117 of 2024(2) dt.24-01-2024 2/2 has been recovered from the petitioner's possession. Inspite of being in custody since 28.8.2023, he has not been put on T.I parade and charge-sheet has been submitted.

5. The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the allegations in the F.I.R, the name of the petitioner having transpired in the confessional statement of co-accused Dipak Kumar, grant of bail to the aforesaid Dipak Kumar, no incriminating article having been recovered from the petitioner's possession, his being in custody for about 5 months since 28.8.2023 and charge-sheet having been submitted in the case without putting the petitioner on T.I parade, the petitioner is directed to be enlarged on bail in connection with Islampur P.S. Case no. 155 of 2023, on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Hilsa, Nalanda.
