JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 27-11-2019 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State. Petitioner seeks bail in a case registered under section 30(a) of Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that there is no recovery from conscious possession of the petitioner and recovery of illicit foreign liquor was made from a house in which petitioner is living as a tenant. He further submits that the petitioner has no criminal antecedent and is in jail custody since 01.10.2019.

In the facts and circumstances of the case, I am inclined to grant bail to the petitioner, subject to deposit of Rs 15,000/- in the court below/ Nazarat. Let the above named petitioner be released on bail on furnishing bail bonds of Rs

Patna High Court CR. MISC. No.75772 of 2019(2) dt.27-11-2019 2/2 10,000/- with two sureties of the like amount each to the satisfaction of the Addl. Sessions Judge II, Banka in Banka P.S. Case no. 701/2019.

Such deposit of Rs 15,000/- shall abide by the outcome of the criminal case.
