2. The petitioner is apprehending his arrest in connection with Sathi P.S. Case No. 158 of 2025 registered for the offences punishable under Sections 126(2), 115(2), 118(1), 109(1), 76, 329(4), 303(2), 191(1) and 190 of the Bharatiya Nyaya Sanhita, 2023.
3. Besides the omnibus nature of the allegation against the petitioner of causing assault to the informant, it is further alleged that he torn the clothes of the informant and threatened with dire consequences.
4. Learned Advocate for the petitioner, taking this Court through the F.I.R., contended that there is omnibus nature of allegation against all the F.I.R. named accused persons,
Patna High Court CR. MISC. No.83158 of 2025(2) dt.17-12-2025 2/3 including the petitioner. So far the allegation of misbehaviour is concerned, the same is nothing but a concocted one. Moreover, the injury, which is allegedly sustained to the informant's fatherin-law and sister-in-law is concerned, the same have been found to be simple in nature. To support the aforesaid contention, the injury reports have been brought on record as Annexure-2 Series to the application. The petitioner bears fair antecedent and he undertakes that he will fully cooperate in the proceedings of the court. It is lastly contended that there is a counter version of the present case, bearing Sathi P.S. Case No. 157 of 2025, registered against the informant and others and the genesis of the occurrence is nothing but a land dispute.
5. On the other hand, learned APP for the State vehemently opposes the bail application and submits that the petitioner has actively participated in the crime.

Having considered the submissions advanced by the learned Advocate for the respective parties and taking note of the nature of accusation, coupled with the factum of case and counter case as well as fair antecedent of the petitioner, besides the nature of injury is said to be simple, let the petitioner, named above, in the event of his arrest or surrender before the court below within four weeks from the date of receipt/production of

No.83158 of 2025(2) dt.17-12-2025 3/3 a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, West Champaran, Bettiah in connection with Sathi P.S. Case No. 158 of 2025, subject to the condition as laid down under Section 482 (2) of the Bharatiya Nagarik Suraksha Sanhita, 2023 with the further condition that one of the bailors shall be the own/close relative of the petitioner.
