JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-12-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 25(1-b)a, 26, 35 of the Arms Act.

One country made gun and three live cartridges are said to have been recovered from conscious possession of the petitioner for which petitioner is in jail custody since 10.06.2019. Petitioner does have criminal antecedent of one case but it is submitted that aforesaid case was lodged against the petitioner on account of enmity.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above

Patna High Court CR. MISC. No.77217 of 2019(2) dt.18-12-2019 2/2 named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, 1st Bagaha, District-West Champaran in connection with Bagaha P.S. Case No. 310 of 2019.
