2. The petitioner seeks bail in connection with Ahiyapur P.S. Case No. 444 of 2023 registered for the offence under Sections 394/302 of the Indian Penal Code and under Section 27 of the Arms Act.
3. As per the prosecution case, three criminals, while trying to commit loot have committed murder of the deceased.
4. Learned counsel for the petitioner submits that the petitioner is innocent and he has falsely been implicated in this case and he petitioner is in jail since 21.07.2023.
5. Learned APP for the State vehemently opposed the prayer of the petitioner for grant of bail by contending that the petitioner's role has come during investigation and he has
Patna High Court CR. MISC. No.3400 of 2024(2) dt.31-01-2024 2/2 participated in the day light killing of the deceased and he has criminal antecedents also.
6. Considering the aforesaid facts and the serious allegation of murder levelled against the petitioner, this Court is not inclined to grant bail to the petitioner
7. Accordingly, this application is dismissed.
8. The trial Court is directed to expedite the trial of all the cases pending against the petitioner.
9. Let a copy of this order be communicated to the District Judge, Muzaffarpur through FAX and e-mail for its compliance.
