====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 02-12-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner seeks bail in a case registered for the offences punishable under Sections 103(1) and 61(2) of the B.N.S., 2023.

3. As per the prosecution case, the informant, namely Kamlesh Bhuiyan, alleged that the F.I.R.-named accused persons, in conspiracy with each other, assaulted and killed the brother of the informant as he used to object to his wife's extramarital affair with co-accused Arvind Bhuiyan.

4. Learned counsel for the petitioner submits that from the F.I.R., it is apparent that the informant is not an eyewitness to the occurrence and that only suspicion has been raised against the petitioner because he is the maternal brother

Patna High Court CR. MISC. No.82821 of 2025(2) dt.02-12-2025 2/2 of co-accused Arvind Bhuiyan, who allegedly had illicit relations with the wife of the deceased. The petitioner is in custody since 11.09.2025 and the charge-sheet has been submitted in this case.

5. Learned A.P.P. for the State vehemently opposed the prayer for grant of bail to the petitioner.

6. Considering the nature of the accusation and the period of custody, the prayer for grant of bail to the petitioner is allowed.

7. Accordingly, let the above-named petitioner be released on bail on furnishing a bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Aurangabad, in connection with Mandanpur P.S. Case No. 273 of 2025.
