The matter has been listed under the heading "For Orders" under the orders of Hon'ble the Chief Justice. Heard learned counsel for the petitioners and learned APP for the State.

The petitioners are apprehending their arrest in a case registered under Section 379 of the Indian Penal Code. Allegedly, in the backdrop of trivial issue, the present case has been instituted in the garb of payment of rent. It has been submitted on behalf of the petitioners that the

Patna High Court CR. MISC. No.79807 of 2019(4) dt.07-09-2020 2/2 petitioners have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. The petitioners happen to be tenant of the complainant. The complainant is landlord and due to dispute for rent of the house, the present mala fide prosecution has been launched.

On behalf of the State, it is submitted that the petitioners are named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances of the case, the provisional bail granted to the petitioners by order dated 09-12-2019, is confirmed.
