ANJANA MISHRA ORAL ORDER 09-12-2019 Heard learned counsel for the petitioner and learned Additional Public Prosecutor on behalf of the State. The petitioner is in custody since 27.11.2018, in connection with Sessions Trial No. 126 of 2019 arising out of Mojahidpur (Babarganj) P.S. Case No. 112 of 2018 for the offences under Sections 3 and 4 of Explosive Substance Act. Learned counsel for the petitioner submits that the allegation against the petitioner is that he had lobed a bomb inside the shop and escaped in the darkness. Learned counsel for the petitioner further submits that there is no eye witness to the same and nothing has been recovered from the possession of the petitioner.
Considering the aforementioned facts and circumstances and the period of custody and that in view of his

No.75858 of 2019(2) dt.09-12-2019 2/2 antecedents alone, the petitioner was not granted bail though there was no material available against him, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District Judge V, Bhagalpur, in connection with Sessions Trial No. 126 of 2019 arising out of Mojahidpur (Babarganj) P.S. Case No. 112 of 2018, subject to the condition that the father of the petitioner must be one of the bailors.
