Heard learned counsel for the petitioner, learned AC to SC-5, learned counsel appearing on behalf of the BSEB and the learned counsel appearing on behalf of the respondent No. 9.

Learned counsel appearing on behalf of the petitioner, at the outset, seeks permission to make rectification in the description of the district of the Respondent Nos. 2 to 5. It is next submitted that inadvertently "District-Jamui" has been

Permission is accorded.

Learned counsel for the petitioner submits that petitioner would be satisfied in the event if the writ application is disposed of with a direction to the District Programme Officer, Munger to consider and dispose of his representation dated 16-10-2024 sent by post (Annexure-P/6). 5.
It is next submitted that petitioner has filed the instant writ application seeking a direction upon the authorities to allow the petitioner to take charge of Principal of Bhojan Mandal College, Haveli Kharagpur, Munger, and to allow him to function smoothly as Principal of the said college. 6.
Learned counsel for the petitioner further submits that the college in question is affiliated to Bihar School Examination Board and the Bihar School Examination Board constituted a Managing Committee and the Managing Committee of the school had recommended the name of the petitioner for being considered for the post of Principal of the aforesaid college, the recommendation of the Managing Committed was approved by the Bihar School Examination Board by its Memo No. 227 dated 23-8-2024 (Annexure-P/5), but then till date the petitioner has not been allowed to function

Learned counsel appearing on behalf of the BSEB submits that the petitioner ought to have approached the Bihar School Examination Board bringing to its notice that Letter No. 227 dated 22-8-2024 issued by the Director (Academic), Bihar School Examination Board, Patna, is not being given effect to, on which the learned counsel appearing on behalf of the petitioner submits that he will file a representation before the Director (Academic), Bihar School Examination Board, Patna, for seeking redressal of his grievance as raised in the instant writ application.

The learned counsel for the State and the Bank do not oppose the said submission of the learned counsel appearing on behalf of the petitioner.

The Court, without going into the merit of the case, disposes of the writ application with liberty to the petitioner to file a representation before the Director (Academic), Bihar School Examination Board, Patna, for seeking relief as raised in the instant writ application.
