The petitioner seeks bail in connection with G.O. Case No. 987 of 2019, arising out of Ashok Paper Mill P.S. Case No. 139 of 2019, registered under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

The accusation is of recovery of 45 bottles, each containing 180 ML, 15 bottles, each containing 180 ML and 03 bottles, each containing 375 ML of Indian made foreign liquor from the hut of the petitioner.

Learned counsel for the petitioner submits that petitioner is in custody since 16.10.2019. Further submission is that while the petitioner is accused in similar nature of case

Patna High Court CR. MISC. No.79318 of 2019(2) dt.14-01-2020 2/2 i.e. Ashok Paper Mill P.S. Case No. 46 of 2018, but he is on bail in that case.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned ADJ-II-cum-Special Judge (Excise Act), Darbhanga in connection with G.O Case No. 987 of 2019, Ashok Paper Mill P.S. Case No. 139 of 2019.
