JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-09-2018 At the very outset, learned counsel for the petitioners has submitted that petitioner No.1 Mohan Yadav, has been arrested during pendency of this application.

In such view of the matter, this application with respect to petitioner No.1 is dismissed as being infructuous. Heard learned counsel for the petitioner Nos. 2 and 3. Petitioners apprehend their arrest in connection with Konch P.S.Case No. 154 of 2018 registered for the offences punishable under Sections 341, 323, 307, 354 and 379/34 of the Indian Penal Code.

Allegation against the petitioners is of assault to the informant.

Patna High Court Cr.Misc. No.51450 of 2018 (2) dt.19-09-2018 2/2 Submission of learned counsel for the petitioners is that there is land dispute between the parties and injury is simple in nature, which will appear from the impugned order itself. Heard learned APP also.

Having heard both sides and in the facts and circumstances, let the petitioner Nos. 2 and 3, named above, in the event of his arrest or surrender, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-III, Gaya, in connection with Konch P.S.Case No. 154 of 2018, subject to the conditions as laid down under Section 438(2) Cr.P.C. and further condition is that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned.
