JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-12-2019 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners seek bail in a case registered for the offence punishable under Section 30(a) of Bihar Excise Act (new).

According to prosecution case itself, the alleged recovery of liquor was made from beneath the seat of a bus and the petitioners were found sitting on the aforesaid seat. Petitioners do not have any criminal antecedent and are languishing in jail custody since 24.09.2019. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioners, above

Case No. 973 of 2019 arising out of Sadar (Bhalpatti O.P.) P.S. Case No. 400 of 2019.
