Counsel for the petitioner submits that the petitioner retired as Research Fellow from Jagjiwan Ram Institute of Parliamentary Studies and Political Research (In short 'Institute'). Her claim for ACP and MACP were duly recommended under communication of Director dated

Patna High Court CWJC No.23820 of 2019(2) dt.31-01-2020 2/2 19.04.2018 bearing letter no. 113. In spite of such recommendation, no action has been taken and the petitioner continued to deprive of the benefit whereas similarly situated persons, namely, Dr. Baban Singh and Dr. Meena Singh have been granted same benefit due to inaction of the authority, namely, Director of Institute (respondent no.5). In view of such submission, there is no occasion for any adjudication at the present.

Matter is therefore, disposed of with direction to respondent no.5 (Director, Higher Education, Govt. of Bihar, Patna) to take final decision on the claim of the petitioner as per recommendation dated 19.04.2018 from the Director of the Institute in accordance with law expeditiously without undue delay. Decision should be by assigning reasons. This court would be pleased, if this exercise is completed within eight weeks from the date of receipt/production of a copy of this order.

Monetary dues which are found dues and admissible should also be paid within eight weeks thereafter. Writ petition is disposed of.
