2. The present application has been filed for modification of the order dated 20-09-2023 passed in Cr. Misc. No. 58628 of 2023, by which the petitioner was granted anticipatory bail in connection with Dhibra PS Case No. 26 of 2021, pending in the Court of learned Spl Judge Excise II, Aurangabad, and the petitioner was directed to surrender in the learned court below within a period of six weeks and furnish bail bonds.

3. Learned counsel for the petitioner submits that petitioner was out of station to earn his livelihood and,

Patna High Court CR. MISC. No.2422 of 2024(2) dt.12-01-2024 2/2 therefore, he could not surrender in the learned court below well within time on account of the reasons beyond his control. It is further submitted that further time may be extended so that the petitioner could surrender in the learned Court below and furnish bail bonds.

4. Considering the submissions made on behalf of learned counsel for the petitioner and the grounds mentioned in the modification application, the period of surrender of the petitioner in the learned court below is extended for a further period of six weeks from today. The rest of the conditions stipulated in the order will be same.

5. The order dated 20-09-2023 passed in Cr. Misc. No. 58628 of 2023, is modified to the extent as indicated above.
