====================================================== CORAM: HONOURABLE MR. JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 31-01-2025 Heard learned Counsel for the petitioner and the learned A.P.P. for the State.

2. The petitioner was granted bail vide order dated 01.10.2024 passed in Cr. Misc. No. 67813 of 2024. While granting the bail, it was observed that the Court below shall verify the criminal antecedent of the petitioner and if it is found that he is involved in any other case except the present one, his bail bond shall not be accepted.

3. Learned Counsel for the petitioner has submitted that due to inadvertence the criminal case pending against the petitioner could not be disclosed in paragraph-3 of the bail application since those cases were registered in the name of Lala

Patna High Court CR. MISC. No.86841 of 2024(2) dt.31-01-2025 2/2 Yadav which is alias name of the petitioner. He has been punished due to this fault and remained in incarceration for more than four months

4. Considering the above-mentioned facts and circumstances, this Cr. Misc. No. 86841 of 2024 is allowed and the order dated 01.10.2024 is modified to that extent.

5. The criminal antecedent of the petitioner shall not be considered as hurdle in acceptance of the bail bond of the petitioner.
