====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 02-12-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner seeks bail in a case registered for the offences punishable under Sections 191(2), 191(3), 190, 115(2), 127(2), 109, 117(2), 61(2), 351(2), 352 and 324(4) of the B.N.S., 2023, and Section 27 of the Arms Act. Subsequently, Sections 103(2) and 3(5) of the B.N.S., 2023 were added.

3. As per the prosecution case, the informant alleged that on 28.10.2024, while he was returning to his village with 45 other people, a white car, which he identified as belonging to Anwar Khan, started following him. At about 02:00 A.M., the occupants of the car began firing at him, during which he received two bullet injuries. It is further alleged that the brotherin-law of Md. Zafar Khan was also attacked on 24.07.2024 in

4. Learned counsel for the petitioner submits that the petitioner is not named in the F.I.R. Around 10 persons are named in the F.I.R. of having fired upon the deceased, whereas the deceased sustained only two bullet injuries. The petitioner is in custody since 26.03.2025.

5. Learned A.P.P. for the State vehemently opposed the prayer for grant of bail.

6. Considering the nature of the accusation and the period of custody, the prayer for grant of bail to the petitioner is allowed.

7. Accordingly, let the above-named petitioner be released on bail on furnishing a bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya, in connection with Chandauti P.S.
