Petitioner is apprehending his arrest in connection with Maker P.S. Case No.242 of 2024, registered for the offence punishable u/s 274, 275 of B.N.S.S 2023 and 30(a) of the Bihar Prohibition & Excise Act, 2022.

Altogether 845 liters of country made spirit has been recovered from the place of occurrence.

It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has not committed any offence. He has been falsely implicated in this case. He submits that the name of the petitioner has been transpired on the basis of disclosure made by the co-accused. Petitioner has got eight

Patna High Court CR. MISC. No.86364 of 2024(2) dt.17-12-2024 2/2 criminal antecedents of similar nature.

Learned APP for the State opposed the prayer for bail . 6.

Considering the aforesaid facts and circumstances and the nature of allegation, I am not inclined to enlarge the petitioner on bail. The prayer for grant of anticipatory bail on his behalf is hereby rejected.

This application is accordingly dismissed.
