2. The petitioner is in custody in connection with Kashim Bazar P.S. Case No. 42 of 2024 for the offence punishable under Sections 448, 341, 323, 308, 379, 435, 427, 504 and 34 of the Indian Penal Code lodged on 17.02.2024 by the informant, Babita Devi.
3. As per the prosecution story, the informant alleged that while she was sleeping with her family, all of a sudden, accused persons entered, armed variously and started assaulting everyone. So far as this petitioner is concerned, he assaulted Punit Ray by iron rod repeatedly with an intention to kill which caused injury to the husband on the head. When she came to rescue, Santu Rai and Amit Rai outraged her modesty. Again, this petitioner and Balbadh Ray assaulted her brother-in-law Rishideo Ray. Allegation of assault is against others also. This led to the
Patna High Court CR. MISC. No.82586 of 2025(2) dt.03-12-2025 2/2 FIR.
4. Earlier, the petitioner alongwith other accused persons moved this Court in Cr. Misc. No. 66707 of 2024 (Ranjeet Ray & Ors. vs. State) and in the said case vide an order dated 16.01.2025 while allowing the anticipatory bail of others rejected the petitioner's case on the ground that the injury has been found to be grievous in nature.
5. It is to be noted that the anticipatory bail was rejected on 16.01.2025 and the petitioner chose to come into judicial custody only on 17.06.2025.
6. There is direct allegation of assault on the head causing grievous injury, the case is of 16.02.2024, the petitioner has criminal antecedent as reflects from paragraph no. 3 of the petition.
7. In that background, for the present, this Court is not inclined to extend him privilege of bail which is accordingly rejected.
