====================================================== CORAM: HONOURABLE MR. JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 18-12-2019 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks bail in connection with Amnour P.S. Case No. 124 of 2019 registered for the offence punishable under Section 392 of the Indian Penal Code.

The prosecution story in brief is that the informant Mithlesh Kumar has been filed this case against unknown criminal alleging that on 10.05.2019 around 8.55 p.m. some criminal came on a four wheeler and asked about way and during of time, which they started snatching his mobile phone and they snatched his mobile and threw on the way. Learned counsel for the petitioner submits that F.I.R. has been lodged against unknown person. He further submits that petitioner is not named in the F.I.R. nothing incriminating articles has been recovered from the possession of the petitioner

Patna High Court CR. MISC. No.78048 of 2019(2) dt.18-12-2019 2/2 and petitioner was not put on T.I.P. He further submits that the name of the petitioner surfaced on the confessional statement of co-accused Raja Kumar. Petitioner is in jail custody since 22.06.2019.

In the facts and circumstances of the case, let the petitioner, named above, be released on bail on furnishing bail bonds of Rs.20,000/- (Rupees twenty thousand) with two sureties of the like amount each to the satisfaction of Court of learned Additional Chief Judicial Magistrate-II, Saran at Chapra in connection with Amnour P.S. Case No. 124 of 2019. (I) Bailors should be local having sufficient immovable property within the jurisdiction of the Court concerned.

(II) Petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the court and shall remain physically present as directed by Court and his absence on two consecutive dates without sufficient reasons, his bail bond shall be cancelled by the court below.

(III) If the petitioner tempers with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioner.
