2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 395 of the I.P.C.

3. The case of the prosecution, in short, is that, some unknown miscreants came at the petrol pump and ask for fuel and they robbed 15-20 thousand rupees from the pocket of the informant and two of them entered the office of the petrol pump and looted cash of Rs. 1,75,000/- from the locker.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. It is further submitted that the petitioner is having antecedent of seventeen

It is also submitted that nothing has been recovered from the conscious possession of the petitioner. Similarly situated co-accused person has already been granted bail by a Co-ordinate Bench of this Court vide order dated 21.08.2024 passed in Cr. Misc No. 56831 of 2024. Moreover, the petitioner is languishing in judicial custody since 20.10.2020.

5. Learned APP appearing for the State has vehemently opposed the prayer of regular bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Jankinagar P.S. Case No. 93 of 2019 on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Purnea/concerned trial Court, with condition(s):- (i) the petitioner shall cooperate in the trial and shall remain physically present on each and every dated fixed at the trial. In case of default in such appearance on two consecutive dates without any plausible reason, the learned trial court will have liberty to cancel the bail bonds of the petitioner.
