2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 341, 323, 504, 506, 307, 302, 34 of the Indian Penal Code and Section 27 of Arms Act.

3. It is alleged that on 19.2.2023 the informant was going to his village from Karup Baszar, on the way he saw that the accused persons along with this petitioner were assaulting his son Ravi Kant Kumar. When the informant tried to save his son, co-accused Ritesh Singh @Tutu and Neeraj put out their pistol and fired due to which informant's son succumbed to injury.

4. Learned counsel for the petitioner submits that the

From perusal of FIR, it appears the specific allegation is against co-accused Ritesh Singh @Tutu and Neeraj who fired upon the son of the informant due to which he succumbed to injury. There is general and omnibus allegation against this petitioner. The petitioner has got no criminal antecedent as stated in para-3 of the bail petition and languishing in judicial custody since 21.2.2023.

5. Learned APP appearing for the state has opposed the prayer of regular bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody period, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Karakat P.S. Case No. 42 of 2023 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-I, Bikramganj, Rohtas.
