The petitioner in the present case is seeking regular bail in connection with Mushahari P. S. Case No. 149 of 2018 registered for the offences punishable under Sections 25(1-b)A and 26 of the Arms Act.

Learned counsel for the petitioner submits that the name of the petitioner has transpired in confessional statement of one Vikash Kumar whose name had also transpired in the confessional statement of the arrested accused. Learned counsel submits that from possession of this petitioner two mobile phones have been recovered. It is further submitted that the petitioner has no criminal history.

Learned APP has opposed the prayer of bail.

No.52444 of 2018(2) dt.28-09-2018 2/2 Considering the facts and circumstances wherein the petitioner has no criminal antecedent, his name has transpired in the confessional statement and two mobile phone is said to have been recovered, let the petitioner Sanjeev Kumar be released on bail on furnishing bail bonds of Rs. 15,000/- (Fifteen thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Judge VI-cum Additional Chief Judicial Magistrate, Muzaffarpur in connection with Mushahari P.S. Case No. 149 of 2018, subject to the condition laid down under Section 437(3) Cr.P.C.
