1. Heard the parties.
2. The petitioner apprehends his arrest in connection with Charkapathar P.S. Case No. 50 of 2025 dated 05.05.2025 registered under Section 318(4), 119(1), 308(5) of the B.N.S. 2023.
3. The prosecution case in short is that on 27.12.2024 an audio tape was made viral on social media by one Sudhir Kumar. In the audio tape Gramin Awas Sahayak of Gram Panchayat Raj -Rajoun namely, Jishan Akhtar (petitioner) was asking for bribe of Rs. 3,000/- to add the name of left families in the list of Pradhan Mantri Awas Yojana (Gramin).
4. Learned counsel for the petitioner submits that the occurrence has taken place on 27.12.2024 and the present F.I.R. has been lodged on 05.05.2025 after more than four months
Patna High Court CR. MISC. No.87052 of 2025(4) dt.11-05-2026 2/2 without explaining the delay in lodging the F.I.R. The B.D.O., Sono (Jamui) in his letter addressed to D.D.C. Jamui has mentioned that audio clip of conversation between Sudhir Kumar and the petitioner Md. Zishan Akhtar was only a joke / banter but due to own interest Sudhir Kumar has made the clip viral. The petitioner has no criminal antecedent.

Regard being had to the submission made by the petitioner, taking into consideration the fact that petitioner holding a public post made a demand of money and audio clip of the same is viral on social media, accordingly, I am not inclined to grant anticipatory bail to the petitioner. The same is rejected.
