The petitioner has filed the instant application for grant of bail in connection with Case No. C2/623/19(District Sitamarhi) registered for the offence punishable under section 30(A) of the Bihar Prohibition and Excise Act 2016. As per the allegation in the FIR, 477 litres of Nepali liquor is said to have been recovered from this petitioner. While other accused persons managed to escape, the petitioner was caught at the spot.

It is submitted by learned counsel for the petitioner that no recovery as alleged has taken place. The petitioner is in custody since 25.9.2019, he has no criminal antecedent and

Having heard learned counsel for the parties and taking into consideration the fact that the petitioner has no criminal antecedent and chargesheet has been submitted in the case the Court is inclined to enlarge the petitioner on bail. Let the petitioner above named be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District Judge-II cum Special Judge, Excise Act, Sitamarhi in connection with Case No. C2/623/19 (DistrictSitamarhi).
