2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 379 of the I.P.C.

3. The case of the prosecution, in short, is that, some unknown miscreants are alleged to have committed theft of Bolero vehicle of the informant.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. It is further submitted that the petitioner is not named in the FIR and his name has surfaced in his self confessional statement. It is also

It is next submitted that the petitioner has sixteen criminal antecedents of similar nature of offence and merely on the basis of the same, his name has been framed in this case. It is lastly submitted that except the self confessional statement of the petitioner there is nothing on record against him. Moreover, the petitioner is languishing in judicial custody since 04.02.2022.

5. Learned APP appearing for the State has vehemently opposed the prayer of regular bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Yogapatti (Shanichary) P.S. Case No. 448 of 2021 on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M.F.C., West Champaran/concerned trial Court, with condition(s):- (i) the petitioner shall cooperate in the trial and shall remain physically present on each and every dated fixed at the trial. In case of default in such appearance on two consecutive dates without any plausible reason, the learned trial court will have liberty to cancel the bail bonds of the petitioner.
