The petitioners seek bail in connection with Majhaulia P.S. Case No. 872 of 2023 instituted for the offence under Section 379 of the Indian Penal Code.

As per prosecution case, informant had gone to attend a Baraat and there he parked his motorcycle, but when the informant came back, he found his motorcycle was missing. 4.

It has been submitted on behalf of the petitioners that the petitioners are in custody since 08-10-2023. Petitioners are stated to be man of clean antecedent.

It has been further submitted by the petitioners'

Patna High Court CR. MISC. No.3711 of 2024(2) dt.30-01-2024 2/2 counsel that petitioners have been falsely implicated in the present case. Names of the petitioners have been surfaced in this case during course of investigation on the basis of confessional statement of petitioner No. 1 made before the police. Petitioners are not named in the FIR. Petitioners have no concern with the alleged stolen motorcyle.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioners. 7.

Considering the aforesaid facts and circumstances of the case, period of custody of the petitioners and nature of accusation, this Court is inclined to grant bail to the petitioners. 8.

Let the petitioners be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Majhaulia P.S. Case No. 872 of 2023.
