A supplementary affidavit has been filed in this case stating therein that the petitioner is an HIV patient. The petitioner is in custody since 02.11.2019 in connection with Araria (Bairgachi) P.S. Case No. 949 of 2019 for the offence registered under Sections 30 (a) and 38 of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that the alleged recoveries were not from his conscious possession and the petitioner has no criminal antecedent.

Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two
