The petitioner is in custody since 16.10.2019, in connection with Piar P.S. Case No. 178 of 2019 for the offence registered under Sections 272, 273, 120(B) of the Indian Penal Code and Section 30(a) of the Bihar Prohibition & Excise Act, 2016.

Learned counsel for the petitioner submits that the alleged recovery is not from the conscious possession of the petitioner but from the hut house of Bablu Ram. It is further submitted that the petitioner has no criminal antecedent.
