JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 28-01-2020 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Belhar P.S. Case No. 231 of 2019 for the offenses under Section 30(a) (g) of the Bihar Prohibition & Excise Act, 2016 and Section 3 of the Bihar Mahua Flower Act.

Allegation against the petitioner is that he was involved in manufacturing country made mahua liquor and from his possession 40 Kg of mahua was recovered on search. Learned counsel for the petitioner submits that petitioner has no criminal antecedent. He is in custody since 02.08.2019.

Considering the fact that the petitioner has no criminal antecedent, let the petitioner, above named, be enlarged on bail

Patna High Court CR. MISC. No.87477 of 2019(4) dt.28-01-2020 2/2 on furnishing bail bond of Rs. 50,000/-(Fifty thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-II, Banka in connection with Belhar P.S. Case No. 231 of 2019.
