JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER (Per: HONOURABLE THE CHIEF JUSTICE) 06-01-2020 The petition filed on 25.08.2018 is listed for hearing for the first time today before the Court.
Heard learned counsel for the petitioner and learned counsel for the respondents.
Petitioner has prayed for the following relief: "a) For issuance of an appropriate writ order, direction, commanding the Respondents to hold an enquiry to find out and fix the appropriate place for running 13 Anganbari centre within the Gram Panchayat Chak Chichaul as the same are being run in complete defiance of the Rules and without keeping in mind the very purpose of establishment of such Anganbari centre.
b) For issuance of an appropriate writ,
Patna High Court CWJC No.17144 of 2018(2) dt.06-01-2020 2/3 order, direction, commanding the Respondents to operate the different Anganbwari Centre under the Gram Panchayat Chak Chichaul within Naubatpur Block in their respective wards on the basis of basic criteria of population.
c) For issuance of a writ, order, direction, commanding the Respondents to run and control the different Anganbari centre within the Gram Panchayat Chak Chichaul as per Anganbari Rules.
d) For issuance of writ, order, direction, commanding the Respondents to shift the proposed Maharajganj-III centre to its appropriate ward as the population of Maharajganj village is very lesser and already Anganbari centre are running in Maharajganj village.
e) For issuance of any other relief or reliefs for which the petitioner is found entitled to in the facts and circumstances of this case." After the matter was heard for some time, learned counsel for the petitioner submits that petitioner shall be content if a direction is issued to the concerned respondents to consider and decide the representation, which the petitioner shall be making afresh within a period of four weeks from today. Learned counsel for the State states that upon receipt of such request, if any, the same shall be dealt with in accordance with law, expeditiously and positively within a period of three months from the date of receipt thereof. Equally, liberty is reserved to the petitioner to take recourse to such alternative remedies as are otherwise available in accordance with law.
