JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 24-07-2020 Once again learned counsel for the petitioner has not joined the proceeding. This is the third occasion on which learned counsel for the petitioner has not attended the case even though this Court has been informed that he has been duly sent the link.

On the last date, this Court had taken note of the information furnished by learned counsel for the State that all the retiral benefits of the petitioner has been paid and he is getting regular pension, therefore, this application has become infructuous. In order to give a last opportunity this Court had fixed the matter for 14th July, 2020 and had made clear that in

Patna High Court CWJC No.25855 of 2019(5) dt.24-07-2020 2/2 case of no response on the next date the matter will be decided on the basis of the materials available on the record. Since, no one has participated in course of hearing on behalf of the petitioner, this Court has reasons to believe that the petitioner has already received his post-retiral dues and is getting his regular pension, hence he is now not interested in pursuing the matter.

This writ application is thus disposed of as having become infructous and as not pressed.
