JUSTICE ASHUTOSH KUMAR ORAL ORDER 09-12-2019 The petitioner seeks bail in connection with Nanpur P.S. Case No. 166 of 2019 dated 14.05.2019 instituted for the offence under Section 395 of the Indian Penal Code and Section 27 of the Arms Act. The case appears to have been registered against five unknown accused persons. The name of the petitioner has transpired on the basis of confession may be a co-accused person. Nothing appears to have been recovered from the possession of the petitioner and till date he has not been put on test identification parade. The petitioner is stated to be in custody since 30.05.2019 and in one other case in which he has been made accused, he has been granted bail.

Considering the aforestated facts the petitioner is directed to be released on bail on his furnishing bail

Patna High Court CR. MISC. No.77478 of 2019(2) dt.09-12-2019 2/2 bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Sitamarhi in connection with Nanpur P.S. Case No. 166 of 2019.
