Petitioner, who is in custody, seeks bail in a case, registered for the offence punishable under Section 401 of the Indian Penal Code.
The informant, who is the police officer, has alleged that on 27.05.2019, while he was on patrolling duty at Jammu platform, two miscreants seeing the police, started fleeing away and one was apprehended by the police and another taking advantage of the darkness managed to escape and apprehended accused disclosed his name as Raja Kumar Sahni @ Raja Bind and person fled away as Gaurav Kumar and admitted that both of them are thieves and engaged in theft in railway and also pick pocketing and from his possession one scissor and one broken
Patna High Court CR. MISC. No.77561 of 2019(2) dt.28-11-2019 2/2 piece of blade was recovered.
Petitioner is accused of three more case of similar nature, as such, he is habitual offender.
Considering the facts and circumstances of the case and nature of allegation, I am not inclined to enlarge the petitioner on bail. Hence, the prayer for bail of the petitioner is hereby rejected at this stage. However, after one year of custody petitioner would be at liberty to renew his prayer for bail. (S.
